Steps After Hiring a Construction Defect Attorney?
The construction defect litigation process can be complicated, so it is highly recommended you work with a construction defect (CD) attorney to help you recover damages for the defects in your home or property. Now that you’ve hired a CD attorney, what happens next?
When you work with one of our attorneys at the Naumann Law Firm, one of the first steps that will occur is a home inspection by both our experts and the builder’s experts. We will schedule a time with you to visit your home where you can show us all the construction defects and issues you have found. Our experts will conduct a thorough inspection to look for other potential construction defects, as well.
After an inspection, our experts may do testing on your home, other homes, or a common area in the community – in the past we have tested water intrusion at the windows, removing siding to look at waterproofing, and taking soil samples from slopes. The testing is performed to better understand the construction of the home and discover how and where the defects are occurring.
During the litigation process, you may be deposed. A deposition is the taking of an oral statement of a witness before a trial, under oath. You will be asked various questions about your home. The purpose of the deposition is to find out what you know and to preserve your testimony. With depositions, both parties will learn all the facts before the trial. Your deposition will continually help us build a strong case on your behalf.
The deposition will usually take place at a legal services office. You will be asked a serious of questions regarding the construction defects related to the lawsuit. Your deposition will be recorded. A deposition usually lasts not more than one day, depending on your case. Our attorney’s will prepare you for your deposition with a phone call the day before, so you can ask us any questions, and help you feel comfortable beforehand.
