Inspections in Your Home During Construction Defect Litigation

One of the first steps after joining a litigation, is a visual inspection of your home. Our team at The Naumann Law Firm will schedule a time with you, to visit your home with our representatives and experts. This is a critical opportunity for you to show us all problematic details of the home, including any construction defects that may not be easily visible. Our representatives and experts will answer any of your questions during this time.
After our initial inspection, per the court, the defense parties are allowed time to perform a visual inspection of your home. We understand that having strangers in your home is not always comfortable. A representative from The Naumann Law Firm is ALWAYS on site to accompany the defense. Do not allow anyone from the defense into your home without a legal representative!
During this defense inspection, you may feel the need to point out to the builder the issues occurring. You may think, “It’s best to show them what they did, so they can fix it!” However, this is the exact opposite of what you should be doing. You need to remember that every individual on the defense side is no longer working for you, nor do they have your best interest in mind. They are looking for any angle to lessen the amount of money they would ultimately have to pay to make repairs. Anything you say could be twisted and used against you and hurt your case.
We ask that during the inspections you and anyone present in the home, please do not talk with any of the defense parties.
The defense team knows they are not allowed to speak with you, but there are rare occasions when a person will disrespect that rule and start speaking with you. If this happens, please do not answer their question, but respond that you need to speak with your counsel or your onsite representative from The Naumann Law Firm.
Before starting any inspections, our representative will give you a brief rundown of what will be occurring. If you have any questions or concerns, please ask the representative to speak in a private area, away from the defense.
