SAN DIEGO, September 21, 2020/ — The following is being issued by The Naumann Law Firm, PC.
The Naumann Law Firm announced today that attorneys, William Naumann Esq., and Loren Shiu, Esq., recently recovered $3,650,000 in damages on behalf of an upscale Orange County homeowners association for construction defects at the property.
On June 19, 2019, the firm filed a lawsuit in the Orange County Superior Court on behalf of Plaintiff against the developer and builders of the project.
The association was constructed in a heavily sloped area. Early in the life of the project, numerous slopes failed and continuously eroded, damaging landscaping and drainage components. Additionally, the asphalt streets continually showed excessive cracking. The cracking was not limited to the asphalt, but driveways, sidewalks, and curbs also showed significant cracking and damage.
Plaintiff experts also discovered that the storm drain system and retention basin had not been constructed properly. Plaintiff’s reserve expert examined the Department of Real Estate budget prepared by the developer and discovered that numerous components were completely omitted. He also determined that there were computation issues related to roadways, wrought iron fences, masonry walls and access gates.
Following multiple mediations before mediator, Ross Hart Esq., the firm successfully obtained a settlement for the Association in the amount of $3,650,000.
