The Naumann Law Firm Recovers $3,150,000 in Damages for Construction Defects Within a Homeowners Association
SAN DIEGO, August 5, 2021 — The following is being issued by The Naumann Law Firm, PC.
The Naumann Law Firm, PC announced today it had recovered $3,150,000 for a large townhouse association in San Diego, CA.
William H. Naumann and Loren K. Shiu of The Naumann Law Firm represented a Homeowners Association comprised of multiple attached townhomes in San Diego, California. The Association brought an action against the developer of the project for various construction defects including but were not limited to defective construction of the building envelope which allowed water intrusion to damage the building improvements. In addition, the investigation revealed inadequate embedment and termination of the buildings’ post tension cables. Furthermore, the Association’s construction experts documented defective construction of soil subgrade and drainage facilities.
Through thorough testing methods and investigation, Plaintiff’s experts proved the inadequate construction.
Plaintiff contended the developer and original contractor were responsible for the defects. Accordingly, Plaintiff was entitled to not only the cost of repair to correct the defects but also the investigative costs incurred to document and develop proper repair recommendations to address the defective conditions.
Mr. Naumann and Mr. Shiu attended multiple mediation sessions and was able to successfully recover $3.15 million for the Association.
